The CPS’s own guidance recognises that suspects and their solicitors can submit evidence and information before a charging decision. We use that opportunity to make sure your position is clearly explained and supported before the prosecutor decides what should happen.
When we can assist
We can help if you have already been interviewed, are on police bail or have been released under investigation. We can also take over this work if another solicitor attended your interview, or if the police have already sent a file to the CPS.

Building your case
We review the allegations and your account to identify the strongest arguments against prosecution. That may mean highlighting weaknesses in the police evidence, correcting misunderstandings or explaining a defence.
We help obtain the evidence needed to support those arguments, including messages, records and witness accounts. We can also identify enquiries the police should pursue and arrange expert advice when specialist evidence needs examination.
Preparing submissions to the CPS
We bring your case together in clear written representations, explaining why charges should not be brought and supporting the arguments with evidence wherever possible.
We send the representations and supporting material to the CPS for the prosecutor making the charging decision. We liaise with the investigating officer and follow up to check that the submission has reached the decision maker. If the case is still with the police, we can put your case to them and ask for our representations to accompany any referral to the CPS.
